1. Acceptance of Terms
By accessing our website, submitting a service request, or using any services provided by FORKN FIX IT ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, you may not use our services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.
2. Services Description
FORKN FIX IT provides mobile forklift repair and maintenance services. Our services include but are not limited to:
- On-site forklift diagnostics and troubleshooting
- Hydraulic system repairs and maintenance
- Electrical and battery system service
- Brake and tire replacement
- Mast and chain inspections and repairs
- Preventive maintenance programs
- Emergency breakdown response
We service electric, propane (LPG), and diesel forklifts from major manufacturers including Toyota, Hyster, Yale, Crown, and Raymond.
3. Service Requests & Scheduling
Service requests can be submitted through our website form, by phone, or by email. By submitting a service request, you:
- Confirm that you are authorized to request service on behalf of the equipment owner
- Agree to provide accurate information about the equipment and issue
- Agree to provide safe access to the equipment at the scheduled time
- Understand that service times are estimates and may vary based on job complexity
We will make reasonable efforts to respond to service requests within 2 business hours during normal operating hours (Monday-Friday, 7:00 AM - 6:00 PM).
4. Pricing & Payment
Estimates: We provide estimates based on the information you provide. Final pricing may vary if additional issues are discovered during service.
Service Charges: Our pricing includes:
- Service call/diagnostic fee
- Labor charges (hourly rate)
- Parts and materials (at cost plus markup)
- No additional hauling or towing fees for on-site service
Payment Terms: Payment is due upon completion of service unless other arrangements have been made in advance. We accept cash, check, and major credit cards.
Late Payment: Invoices not paid within 30 days may be subject to a 1.5% monthly finance charge.
5. Warranty
Labor Warranty: We warrant our workmanship for 30 days from the date of service. If the same issue recurs within this period due to our work, we will re-service at no additional labor charge.
Parts Warranty: Parts installed by FORKN FIX IT carry the manufacturer's warranty. We will assist with warranty claims for parts we supply and install.
Exclusions: Warranty does not cover damage caused by misuse, neglect, accidents, unauthorized modifications, or normal wear and tear.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- FORKN FIX IT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, business opportunities, or production downtime
- Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim
- We are not responsible for pre-existing conditions or damage not caused by our service
7. Indemnification
You agree to indemnify, defend, and hold harmless FORKN FIX IT, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.
8. Cancellation Policy
Customer Cancellation: Please provide at least 4 hours notice if you need to cancel or reschedule a service appointment. Cancellations with less than 4 hours notice may be subject to a trip charge.
Company Cancellation: We reserve the right to cancel or reschedule service due to weather, safety concerns, or other circumstances beyond our control. We will make reasonable efforts to reschedule at your earliest convenience.
9. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
Any disputes arising from these Terms or our services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Broward County, Florida.
